Deposit Cap and the Tenant Fee Ban – ENGLAND ONLY

From 1st June 2019, landlords in England are subject to new rules regarding tenancy deposits and fees under the Tenant Fees Act.

Deposit Cap
For all new and renewed tenancies:

• Deposits are capped at the equivalent of five weeks’ rent for properties with an annual rent under £50,000.
• For properties with an annual rent of £50,000 or more, the cap increases to six weeks’ rent.

Tenant Fee Ban
The legislation also limits what landlords and letting agents can charge tenants. Most fees, including administrative costs, are now prohibited. Only certain charges, such as late rent payments or replacing lost keys, are permitted, and these are strictly regulated.
